Not Illegal to Record Cops

Although I realized it, it was brought to my attention that the title of this post is confusing.  So, I will clarify not by changing the title of the post, but to add this little bit:  In some places it is still illegal to record the police, just not in the Boston Area.  

Frequently on this blog, I talk about something being “illegal” or “legal” when it really only applies to a certain geographic region.  My objective is to make the cumulative case that there are too many laws.  Some examples will only apply to certain parts of the country.

This subject makes an appearance in my upcoming book.  There have been incidents in the past when people were told they could not record or take pictures of police officers.  Some people have even been arrested for it.  But, thankfully, it’s not illegal after all.  A federal court ruled on the matter recently.

Well I've never had reason to think about not being able to take a picture of a cop. Now I do!

It's true, the Supreme Court has not ruled on it yet. But, it might happen in the future. This topic is definitely gaining steam as a first amendment issue.

Unless and until the SUPREME Court rules on this, it only obtains in the Boston area. That's why MD, VA, CA, AZ among others are still beating the crap and arresting videographers.
